Terms Of Service

Welcome to Brick Works! These Terms of Sale (“Terms”) govern all purchases of products and services from Brick Works (“we”, “us”, “our”). By placing an order with us, you (“Customer”, “you”, “your”) agree to be bound by these Terms.

1. Orders & Acceptance

• All orders are subject to acceptance by Brick Works.
• A submitted order does not constitute a binding agreement until confirmed in writing (email, invoice, or purchase order).
• All orders require proof approval before production.

2. Pricing

• All prices are listed in [USD] unless otherwise stated.
• Prices are subject to change without notice prior to order confirmation.
• Quoted prices are valid for 30 days unless otherwise specified.

3. Payment Terms

• Payment is due as follows:
  • Payment terms are determined based on the scope and scale of the project, the client’s standard purchasing policies, and the required delivery timeline.
  • Certain projects may require a 50% deposit to initiate production and secure necessary materials, while others may necessitate full payment in advance, depending on the nature and requirements of the order.
• We accept payments via [list methods: credit card, ACH, check, etc.].
• Brick Works reserves the right to apply rush service fees for expedited orders, as well as late payment fees for invoices not paid within the agreed-upon terms.

4. Artwork & Proofing

• All custom orders require artwork approval.
• Final production will not begin until written approval of proofs is received.
• Delays in proof approval may affect delivery timelines.

5. Production & Lead Time

• Rush services may be available for an additional fee.
• Lead times are estimates and may be affected by factors beyond our control. Production lead times will be specified at the time of project quotation, based on the scope and requirements of the order.

6. Shipping & Delivery

• Shipping costs are the responsibility of the Customer unless otherwise stated. They can be estimated and otherwise added accurately to the balance invoice.
• Risk of loss transfers to the Customer upon shipment.
• We are not liable for carrier delays or damages once items leave our facility but we will do our best to cooperate with you to make it right.

7. Returns & Claims

• All sales are final on custom merchandise.
• Defective or incorrect items must be reported within 5 business days of delivery.
• No returns will be accepted without prior authorization.
• If a return is authorized, items must be returned in original condition.

8. Cancellations

• Orders may be canceled only prior to proof approval and production.
• If production has begun, the full order amount remains due.
• Any costs incurred before cancellation (e.g., artwork, setup) will be invoiced.

9. Intellectual Property

• We reserve the right to refuse any artwork for any reason.

10. Limitation of Liability

• Brick Work’s liability is limited to the value of the products sold.
• We are not responsible for indirect, incidental, or consequential damages.

11. Brand Attribution

• Brick Works reserves the right to include discreet branding such as “Manufactured by Brick Works” on any product or packaging created for the Customer.
• This branding will be applied in a subtle and professional manner, typically in a location that does not interfere with the product’s primary design or branding purpose.
• If you require the exclusion of our branding for any reason, a written request must be made prior to production.
• Brick Works reserves the right to include its standard legal disclaimer or attribution line on all client products and packaging, unless otherwise agreed upon in writing. This disclaimer will be presented to you upon passing over a design template for the packaging.

12. Portfolio & Social Media Use

• We retain the right to photograph and feature final products created for the Customer in our marketing materials, including but not limited to our website gallery, social media feeds, printed catalogs, and promotional campaigns.
• These uses may include the Customer’s branding as it appears on the product unless the Customer submits a written request to opt out at the time of order.
• Proprietary or sensitive projects (e.g., pre-launch items or internal-use products) may be exempt upon mutual agreement.
